Israel’s Supreme Court on Monday issued a significant ruling in the longstanding legal battle over Ponovezh Yeshiva in Bnei Brak, postponing the eviction of the yeshiva headed by Hagaon HaRav Shmuel Markowitz until 10 Av 5787, in August 2027.

Supreme Court Justice Ofer Grosskopf ruled that an institution housing more than 1,200 bochurim and avreichim cannot reasonably be forced to vacate its premises in the middle of the academic year.
The decision came in response to a request filed by HaRav Markowitz and the Mesoras HaTorah organization seeking to suspend enforcement of an arbitration ruling ordering the yeshiva to vacate the disputed property and pay approximately NIS 10 million.
Attorneys representing the Kahaneman family had sought immediate enforcement of the eviction order. However, Justice Grosskopf determined that removing an educational institution of this size during the school year would cause substantial disruption.
According to documents submitted to the court, the yeshiva and its affiliated kollelim currently have 1,266 talmidim and avreichim, including 226 minors and approximately 837 dormitory residents.
The petitioners argued that an immediate eviction would severely disrupt the lives and learning arrangements of hundreds of bochurim.
The court also addressed the substantial financial obligation imposed by retired Justice David Cheshin, who served as arbitrator in the dispute. Grosskopf expressed reservations about enforcing a financial penalty of approximately NIS 10 million that could potentially lead to the collapse of an educational institution serving so many talmidim.
Despite Monday’s ruling, the decades-long *legal battle remains *unresolved.
A separate request for permission to appeal the arbitration ruling, submitted by the administration of HaRav Markowitz’s yeshiva, is expected to be heard at a later date before Supreme Court Justice David Mintz.
For now, the decision provides the yeshiva with additional time and prevents an immediate eviction, while the underlying questions surrounding ownership of the property, the validity of the arbitration ruling, and the multimillion-shekel financial obligation remain before the courts.
